The ZBA is that it is a quasi-judicial group which rules on appeals from decisions of the City’s Zoning Administrator.
Our case involves the zoning boards decision that Trinity failed to establish its use of the property located at 3125 North University as a medical cannabis dispensary within one year of your application for a zoning certificate on September 16, 2014. Accordingly, the zoning board revoked our zoning certificate. Since the City Council adopted a requirement (after September 16, 2014) that medical cannabis dispensaries must have a “special use permit”, the zoning boards ruling has the effect of forcing Trinity to go through another, lengthy process to secure permission from the Zoning Commission and the City Council before you can commence operations. We disagree with the zonings board decesion and disagree that they have such authority to revoke our zoning certificate.
